These Terms of Service ("Terms") govern your use of youraiaccess.com and any Your AI Access card ("Card"), whether digital or physical, purchased through us or received as a gift or scholarship. Your AI Access is a program operated by Biz Dev App Services LLC, a Texas limited liability company ("we", "us", "our").
By purchasing, receiving, or redeeming a Card, you agree to these Terms. If you do not agree, do not use the Card.
A Card is a spend-restricted access credit denominated in US dollars, redeemable at any provider approved into the Your AI Access network at the time of redemption. A Card:
You are purchasing access, not currency.
Cards are minted immediately upon successful payment. Digital cards are emailed to the recipient email you supplied within 60 seconds. Physical cards ship within 5 business days from our fulfillment partner. You will receive tracking information by email when physical cards ship.
Cards expire 5 years (1,825 days) from the date of issuance. This is disclosed at checkout and printed on physical cards. Any unredeemed balance at expiration is forfeited; see Section 6.
Cards are redeemed by entering the code on /redeem or by following the redemption URL emailed with the Card. Partial redemptions are allowed — you can spend $40 of a $100 Card at Provider A and the remaining $60 stays on the Card for later use at any approved provider.
Once credit is applied to your account with a provider, that credit is subject to the provider's own terms of service. If you dispute a charge with the provider, you must resolve it with them directly — we cannot pull back credit that has already been applied.

All fees are disclosed and itemized at checkout before you pay. There are no ongoing or "dormancy" fees on Cards.
Full refund available within 30 days of purchase if the Card has not been redeemed (even partially). Refund is issued to the original payment method. Processing fees are refunded; program margin is refunded.
Partially-redeemed Cards are non-refundable. Credit already applied to a provider account cannot be recovered.
Physical cards may be returned unopened within 30 days for a refund of face value and program margin. The physical card surcharge is non-refundable once the card has shipped.
Scholarship donations are voluntary and non-refundable. Once donated, the funds are pooled and allocated to recipient cohorts per the program's fund allocation process. You will receive a tax receipt reflecting the donated amount.

We reserve the right to cancel any Card obtained in violation of these Terms and to refund the purchase to the payment method used, less any redeemed value.
Any balance remaining on a Card at expiration (5 years from issuance) is forfeited to the program and is used to fund the scholarship pool. This is standard industry practice for spend-restricted access credits and is disclosed here and at checkout.
If a Card is about to expire, we send a reminder email at 30 days and 7 days before expiration to the address on file for the Card holder.
Providers are added to and removed from the network over time. If a provider is removed:
THE PROGRAM AND CARDS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PROGRAM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR PROVIDER WILL REMAIN IN THE NETWORK.
We warrant that Cards will function as described (i.e., a valid, unredeemed, unexpired Card will unlock credit at any approved provider). If a Card fails to function due to our error, our sole obligation is to reissue an equivalent Card or refund the face value.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PROGRAM IS LIMITED TO THE FACE VALUE OF THE CARD(S) AT ISSUE. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF USE OF ANY PROVIDER TOOL.
You agree to indemnify and hold Biz Dev App Services LLC harmless from any claim arising from your misuse of a Card, breach of these Terms, or violation of applicable law in connection with your use of the program.
Before initiating any formal dispute, contact us at bill@bdsrvs.com with the subject "Dispute — [your name]" and a description of the issue. We commit to responding within 5 business days and attempting resolution in good faith for at least 30 days.
If informal resolution fails, any dispute arising out of or relating to these Terms shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will take place in Harris County, Texas, unless you and we agree otherwise. You may opt out of arbitration by emailing bill@bdsrvs.com with subject "Arbitration Opt-Out" within 30 days of first accepting these Terms.
Except as prohibited by law, you and we agree that disputes will be brought only in an individual capacity, not as part of a class or representative action.
Nothing in this section prevents either party from bringing a claim in small-claims court if it qualifies.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. To the extent any dispute proceeds in court rather than arbitration, exclusive jurisdiction lies in the state and federal courts of Harris County, Texas.
We may update these Terms as the program evolves. Material changes will be announced by email to registered users at least 14 days before the effective date. Continued use of the program after the effective date constitutes acceptance of the updated Terms.
